Buyer and Seller agree to the following conditions as stated below:
Every puppy is guaranteed to be purebred and AKC registration is given to Buyer*. Every puppy has been health checked by an experienced veterinarian and is guaranteed to be free of any serious, life threatening condition. Any prior surgeries or known illness will be stated. Buyer has 72 hours after receiving the puppy to have a veterinarian (we advice to look for a breed experienced veterinarian) to practice a second health check, consider that this is in your own benefit. A copy of such health check report (signed over by a licensed D.V.M.) must be faxed or e-mailed to BULLDOGS' VALLEY no later than 5:00pm CT on the third day after receiving the puppy; failure to do so invalidates this contract and renders it null and void, therefore no refund, reimburse or exchange will be given for any reason. If your veterinarian finds a life threatening disease you must contact BULLDOGS' VALLEY immediately (that day) with written findings of the problem. If this occurs, the puppy must be returned to BULLDOGS' VALLEY immediately in order to get a full refund for the initial cost of the puppy (no refund will be given for any shipping cost, this is at Buyer's expense) or an exchange puppy can be provided if available (Shipping cost is at Buyer's expense unless other arrangements are agreed upon by both, Seller and Buyer); Seller will not be responsible for any medical expenses incurred. Puppy must be returned in the condition it was received and all paper work must be returned along with AKC registration signed back over to BULLDOGS' VALLEY before any refund or exchange is given. Any deposit or payment will be refunded under any reason, and no exchange puppy will be provided if the puppy was spayed or neutered under Buyer's petition, prior or after shipping; likewise if the puppy was neglected or injured. If you choose to keep the puppy, written consent must be sent (by e-mail, mail or fax) to BULLDOGS' VALLEY. In like manner, written consent from BULLDOGS' VALLEY will have to be given before any money will be paid for surgery or illness (Amount must not exceed one half of the original price paid for the puppy, original invoices must be provided to Seller). Absolutely no surgery, veterinarian bills or illness treatment will be paid for by BULLDOGS' VALLEY without prior written consent, under any circumstances. The Seller reserves the right to buy back any puppy (for the initial cost) before any major surgery or illness treatment is performed. If any minor breed related, treatable or correctable conditions arise such as (but not limited to) cherry eye, entropian (eyelid surgery, upper & lower), elongated pallet, inverted tail, respiratory, or skin problems of any kind, these are not covered by BULLDOGS' VALLEY. Hip, elbow, and knee dysplasia can be a result of environmental problems such as lack of proper nutrition, exercise, floor surface, being allowed to jump down or falling off of taller structures or rough housing with other pets or humans. Due to this, BULLDOGS' VALLEY cannot guarantee hip, elbow, or knee dysplasia beyond the initial health check. Infectious diseases are not covered by our health guarantee, as we have no control over what the puppy is exposed to after he/she leaves our home. In the event of death, a full autopsy must be practiced to establish cause of death; such autopsy report must be faxed or emailed to BULLDOGS' VALLEY. Please research breed related problems before purchasing a Bulldog puppy. Efforts are made that none of these things will ever affect your puppy but due to the nature of the Bulldog breed one or more of these problems could occur. Fertility of males or females can not be guaranteed, there is no guarantee or warranty that the Buyer will be able to show or breed the puppy regardless of Show or Breeding potential. No guarantee after one year from the puppies' date of birth.
All deposits are NON REFUNDABLE, unless the puppy does not pass the vet check prior to shipping. If a deposit is paid on a puppy and the final payment is not received by the due date (no later than 7 days before the expected shipping date), and prior written arrangements have not been made, Seller has the right to keep the deposit and sell this puppy to another party. If Buyer decides to cancel sale under any reason, the deposit will be kept and a US$200 cancellation fee will be added.
Puppies must be at least 8 weeks old to be shipped or picked up; full payment for puppy, shipping cost and any other fee must be received for puppy to be shipped or given to Buyer.
The shipping date is subject to puppy's health, weather conditions and flight availability; we will ship our puppies only when the weather permits, please understand that the puppy's safety is our main concern. Every puppy will leave us healthy with a current USDA Veterinarian Health Certificate as a proof; this along with an Acclimation Certificate will be provided to the airline. Every puppy will be shipped in an airline approved crate from Kansas City Int'l Airport; we usually ship the puppies by Continental Airlines, American Airlines or Delta, always using the best service available.
If air shipping becomes impossible because of the extreme temperatures in certain months, then you should consider the ground shipping, which is very comfortable for puppies and safe at any time of the year; otherwise you are responsible for picking up your puppy.
This puppy has had the necessary vaccinations, de-worming, and parasite preventions as of the date of sale. This puppy is not fully protected against diseases until the final vaccinations are received up to 16 weeks old. Buyer must maintain proper vaccinations on time and keep records of this, must provide an adequate shelter, proper diet and loving treatment.
To support Responsible Breeding and to prevent any health conditions to be passed on in the bloodlines of Bulldogs, the puppies Sold to "Pet Homes" must be spayed/neutered before the 6 months of age at the buyer's expense.
*The "Pet only" puppies will be sold with restrictions on its registration papers which will restrict the buyer from ever breeding the dog.
At no time is the Seller responsible for defects/conditions caused by Buyer's neglect, abuse, improper nutrition, mishandling or injuries to the pup/adult dog caused by said conditions. Seller declines any liability in the event of any accident involving the pup/dog which shall not be limited to dog bites or personal or property damage.
Buyer assumes that this contract was read, understood and agreed upon by the buyer before the purchase of a puppy.
This contract is valid only for the original buyer and dog, it is non-transferable.
THIS PUPPY IS SOLD UNDER THE LAWS OF THE COUNTY OF ANDERSON AND THE STATE OF KANSAS. THIS CONTRACT IS BINDING AND PROCEEDS ALL OTHER CONTRACTS AND LAWS.
ANY LEGAL ISSUE WILL BE SETTLED AND DISPUTED IN THE JURISDICTION OF ANDERSON COUNTY, KANSAS.
